מדיניות פרטיות האתר

1.כללי
1.1. מסמך זה נועד להסביר למשתמשי האתר והשירותים של “אייל מדיה” (להלן: "החברה" / "אנו") כיצד אנו אוספים, משתמשים, שומרים ומגנים על מידע אישי.
1.2. המדיניות מנוסחת בהתאם לחוק הגנת הפרטיות, התשמ"א–1981, תקנות הגנת הפרטיות (אבטחת מידע), התשע"ז–2017, חוק התקשורת (בזק ושידורים), סעיף 30א, וחוק הגנת הצרכן.
1.3. השימוש באתר מהווה הסכמה למדיניות זו בכפוף להסכמות מפורשות הניתנות בממשקים הייעודיים (טפסים, cookies, דיוור)
1.4. ככל שהמשתמש אינו מסכים – עליו להימנע משימוש בשירותים הדורשים מסירת מידע
2.סוגי מידע שאנו אוספים
2.1 מידע אישי
מידע המזהה אותך באופן ישיר, כגון:
- שם מלא
- מספר טלפון
- כתובת דוא״ל
- התכתבויות מולנו
- מטרה שלשמה השארת הפרטים
- ותשובות מילוי טופס
2.2. מידע רגיש
מידע רפואי, מידע גנטי, מידע על נטייה מינית, עבר פלילי, נתוני חשבון בנק וכרטיס אשראי, אמונה דתית או השקפה פוליטית, כאשר אלה משויכים לאדם מזוהה (כהגדרתו בחוק): אינו נאסף אלא אם המשתמש מוסר אותו מיוזמתו בלבד (למשל פרטי בריאות במסגרת שיחה). איננו מבקשים כל סוג של מידע רגיש. וגם אם במקרה הגיע לידי העסק מידע כזה, המידע אינו נשמר מעבר לנדרש, אינו משמש לכל מטרה עסקית, ונמחק בהקדם האפשרי ובהתאם לנהלי אבטחת המידע של העסק
2.3 מידע טכני
אנו משתמשים בכלים כגון: Cookies, Facebook\Meta Pixel tracking, TikTok Pixel, Google Analytics ואמצעי מדידה נוספים.
מידע שעשוי להיאסף:
- כתובת IP
- סוג המכשיר והדפדפן
- דפי גלישה
- משך שהייה
- פעולות באתר
- מיקום גיאוגרפי משוער
- מזהי פרסום (Advertising IDs)
- נתוני שימוש באתר
3.דרכי איסוף המידע
- בעת השארת פרטים באתר / טפסים
- הרשמה למאגר דיוור
- פנייה דרך וואטסאפ או רשת חברתית
- צפייה בתוכן דיגיטלי
- רכישת מוצר דיגיטלי
- תיעוד שיחות, התכתבויות והודעות עשוי להישמר לצורכי שירות, תיעוד ועמידה בדין
- ככל שמבוצעת הקלטת שיחה, הדבר ייעשה בהתאם לדין ותוך יידוע המשתמש
- באמצעות טכנולוגיות צד שלישי (Analytics, Ads)
4.מטרות עיבוד ואיסוף המידע עפ"י הדין הישראלי
4.1. אנו משתמשים במידע לצורך:
- יצירת קשר ומתן שירות מבוקש
- אספקת מוצרים דיגיטליים / גישה להדרכות
- התאמת תוכן שיווקי וחוויית המשתמש באתר
- ניהול פגישות, צריכת תכנים, מוצרים דיגיטליים ושירותי ליווי.
- ניתוח נתונים ושיפור חוויית המשתמש
- תיעוד לצורכי ניהול עסק.
- עמידה בדרישות חוק, מניעת הונאות ואבטחת מידע
- קבלת החלטות עסקיות ואופטימיזציה של שירותים
- ניהול קמפיינים ופעולות רימרקטינג
- שליחת הצעות, תכנים ומסרים שיווקיים – רק בכפוף להסכמה מפורשת לפי סעיף 30א.
4.2. עמידה בדרישות החוק וניהול סיכונים משפטיים, תפעוליים ואבטחת מידע.
5.מסירת מידע לצדדים שלישיים
מסירת מידע תעשה רק במידה הנדרשת ורק לגופים העומדים בדרישות החוק:
- ספקי אחסון (Google, iCloud, Drives)
- ספקי עבודה מקושרים לעסק - עורך וידאו, בונה אתרים אוטומציות ומערכת CRM
- ספקי סליקה מורשים – קארדקום
- מערכות דיוור (רב מסר)
- מערכות אוטומציה (n8n\Zapier/Make\CobWeb CRM)
- מערכת CobWeb CRM, מערכת ניהול לידים Google sheets. העסק עושה שימוש במערכת CRM המופעלת ומתוחזקת על ידי ספק חיצוני, הפועל כמעבד מידע בלבד ובהתאם להנחיות העסק, המידע מנוהל במאגר מידע בהתאם לחוק והתקנות.
- פלטפורמות פרסום (Meta, TikTok, Google)
- רואה חשבון ומערכות סליקה (כפוף להסכם)
- רשתות חברתיות לצורך פרסום
- ספקי שירות המסייעים לתפעול העסק
כל צד שלישי מחויב לעמוד בדרישות הגנת הפרטיות והאבטחה בהתאם לסעיף 13 לחוק, ולתקנות הגנת הפרטיות (אבטחת מידע), התשע״ז–2017.
אין אנו מוכרים או מעבירים מידע לצורך שאינו נדרש להפעלת השירות.
6.העברת מידע מחוץ לישראל
יתכן שהמידע יאוחסן על שרתים הנמצאים מחוץ לישראל (למשל Google Cloud, iCloud). העברת המידע נעשית רק למדינות בעלות רמת הגנה נאותה או בהתאם להתחייבויות חוזיות מתאימות בהתאם לדין ולהוראות תקנות אבטחת מידע ולהנחיות הרשות להגנת הפרטיות. לרבות באמצעות מנגנונים חוזיים מקובלים.
7.מידע מרשתות חברתיות
אם אתה מתקשר עם העסק דרך:
- TikTok
- Telegram
- YouTube
אנו עשויים לקבל מידע שהפלטפורמה מאפשרת לפי הרשאותיה.
8.מידע על רכישות ותשלומים
בתהליך רכישת שירות/מוצר:
- נתוני סליקה (מעובדים ע"י ספק מוסמך בלבד – איננו שומרים\חשופים לפרטי כרטיס אשראי)
- כתובת חשבונית - נשמרת בהתאם לחוקי המס בלבד
- היסטוריית רכישות
- קבלות ותיעוד העסקאות
העסק אינו נחשף לפרטי כרטיס האשראי של הלקוח.
העסק נחשף לפרטי העסקה והחשבונית לצורך ניהול, שירות ועמידה בדרישות הדין בלבד.
9.תקופת שמירת מידע
המידע יישמר רק כל עוד הוא דרוש:
- למתן השירות
- לעמידה בדרישות חוק (חשבוניות, מס, דיווחים)
- למנוע מחלוקות עתידיות
מידע שאין בו צורך – יימחק בהתאם לדין ולהוראות תקנות הגנת הפרטיות (אבטחת מידע), התשע״ז–2017
המידע נשמר בהתאם לדרישות הדין ולצרכים העסקיים בלבד – לפי צורך.
10.שימוש ב- Cookies וטכנולוגיות מעקב
10.1. האתר משתמש ב־Cookies, פיקסלים זיהוייים ומזהים פרסומיים לצורך ניתוח ושיווק.

המשתמש יכול לחסום עוגיות בהגדרות הדפדפן.
10.2. בעת הכניסה לאתר יוצג פופ-אפ הסכמה תקני המאפשר:
- לאשר הכול
- לאפשר רק Cookies הכרחיים
- לדחות איסוף מידע לא הכרחי
כלי שיווק ו־Retargeting יופעלו רק לאחר קבלת הסכמה מפורשת
10.3. מידע לא חיוני לא ייאסף ללא הסכמה.
11.אבטחת מידע – עמידה מלאה בתקנות
בהתאם לסעיפים 17א ו־17ב לחוק ומסגרת תקנות אבטחת מידע: העסק מתחייב ליישם את כל הדרישות הבאות:
11.1 נהלים ארגוניים
- מסמך אבטחת מידע פנימי לשמירת המידע - קיים.
- מינוי אחראי הגנת פרטיות - אייל אלמליח (בהמשך המדיניות קיימת דרך ליצור קשר).
- בקרות הרשאות גישה
- אחסון מאובטח בענן
- בדיקת סיכוני אבטחת מידע שנתית
- נהלי התמודדות עם אירוע אבטחה
- עבודה רק עם ספקים שעומדים בתקני אבטחת מידע בינלאומיים
- למרות זאת, איננו יכולים להבטיח אבטחה מוחלטת.

11.2 אמצעים טכנולוגיים
- הצפנת מידע ותקשורת (SSL)
- שימוש בסיסמאות חזקות ואימותים דו שלביים
- גיבויים מאובטחים בסביבות נפרדות בהתאם לסוג המידע
- תיעוד גישה למידע
11.3 אירוע אבטחת מידע
במקרה של חשש לדליפה:
- תבוצע חקירה פנימית
- משתמשים ייעודכנו בהתאם לחוק
- הרשות להגנת הפרטיות תעודכן במידת הצורך
12.מסרים פרסומיים – סעיף 30א
12.1. לא יישלחו מסרים פרסומיים, דיוור ללא checkbox מפורש/הסכמה מפורשת ומראש מהמשתמש בהתאם להוראות סעיף 30א לחוק התקשורת.
12.2. בהשארת פרטים אתה מאשר קבלת: מסרים/הודעות ווצאפ/דיוור במייל. כל הודעת ווצאפ/מייל/מסרון יכללו אפשרות הסרה מרשימת הדיוור ובמידה ולא קיימת ניתן לפנות לעסק דרך המייל eyalelmaliach2@gmail.com או דרך הווצאפ במספר 055-3062277.
12.3. כל הסרה תבוצע מיידית או עד 3 ימי עסקים לכל היותר.
12.4. כל משתמש רשום יכול להסיר עצמו ביצירת קשר אל מול העסק.
13.אפיון והבדל
13.1. "לקוח" - אדם המקבל שירות/ליווי/מוצר בתשלום
"משתמש אתר" - כל אדם אשר נמצא באתר ובדפים הכפופים אליו ורשאי לצרוך את התכנים החינמיים שחשוף אליהם באתר.
"ליד" - אדם אשר השאיר פרטים באתר ובדפים הכפופים אליו/פלטפורמה אחרת, לטובת יצירת קשר וקבלת שירות.
13.2. מדיניות ותנאי האתר חלים על כל משתמש באתר וכן כל אדם אשר השאיר פרטים בטופס ההרשמה באתר (הרשמות כליד), במידה והינך בזמן מסויים הופך ללקוח של העסק (בין אם בשירות שתקבל או מוצר שתקנה) ככל הנראה יידרשו ממך כ-"לקוח" פרטים נוספים שאינם כלולים במדיניות זו מנותן השירות (בעל העסק) כגון: מידע אישי ומידע רגיש – ככל שנדרש ובכפוף לדין, על מנת לקבל את השירותים והמוצרים - חומרי גלם ומדיה, דרכי יצירת קשר, סיסמאות למשתמשים, פרטי חשבון ואשראי לסליקה, כתובת, תשובות וחתימות מסמכים ושאלונים בעלי דעת אישית ופרטים אישיים וכדומה... ולכן חלים הסכמי עבודה, מדיניות ותקנון נפרדים ומותאמים לכל מוצר ושירות שהעסק מציע במעמד העסקה באישור והסכמה ושקיפות מלאה של מקבל השירות/רוכש המוצר להלן הלקוח.
13.3. אופן שימור מידע לקוחות מוסדר גם בהסכמים ייעודיים נוספים.
14.זכויות משתמשים (חוק ישראלי)
למשתמש יש את הזכויות:
- לבקש עותק מהמידע
- לבקש תיקון מידע
- לבקש מחיקה ממאגר הלידים והנתונים שנאספו (“להישכח”)
- להתנגד לשימוש שיווקי והסרה מרשימות תפוצה
- למשוך הסכמה בכל עת

15.התייחסות קטינים
השירות והאתר אינו מיועד לגיל מתחת ל־18. במקרה של איסוף מידע מקטין – ההורה רשאי לבקש מחיקה מיידית.
16.שינויי מדיניות
מדיניות זו עשויה להשתנות מעת לעת. עדכון מהותי יפורסם באתר.
17.יצירת קשר בנושא פרטיות

1.General
1.1. This document explains to users of the website and services of “Eyal Media” (the “Company” / “we”) how we collect, use, store and protect personal information.
1.2. This policy is drafted in accordance with the Israeli Privacy Protection Law, 5741-1981, the Privacy Protection (Data Security) Regulations, 5777-2017, the Communications Law (Bezeq and Broadcasting), Section 30A, and the Consumer Protection Law.
1.3. Using the website constitutes agreement to this policy, subject to explicit consents given in the dedicated interfaces (forms, cookies, mailing).
1.4. A user who does not agree should refrain from using services that require providing information.
2.Types of information we collect
2.1 Personal information
Information that directly identifies you, such as:
- Full name
- Phone number
- Email address
- Correspondence with us
- The purpose for which you left your details
- Answers you filled in a form
2.2 Sensitive information
Medical information, genetic information, sexual orientation, criminal record, bank account and credit card data, religious belief or political opinion, when attributed to an identified person (as defined by law): is not collected unless the user provides it on their own initiative only (for example health details during a conversation). We do not request any kind of sensitive information. Even if such information happens to reach the business, it is not kept beyond what is necessary, is not used for any business purpose, and is deleted as soon as possible in accordance with the business's information security procedures.
2.3 Technical information
We use tools such as: Cookies, Facebook/Meta Pixel tracking, TikTok Pixel, Google Analytics and additional measurement tools.
Information that may be collected:
- IP address
- Device and browser type
- Pages browsed
- Time spent
- Actions on the website
- Approximate geographic location
- Advertising IDs
- Website usage data
3.How information is collected
- When leaving details on the website / forms
- Signing up to a mailing list
- Contacting us via WhatsApp or a social network
- Viewing digital content
- Purchasing a digital product
- Records of calls, correspondence and messages may be kept for service, documentation and legal-compliance purposes
- Where a call is recorded, it will be done in accordance with the law and with notice to the user
- Through third-party technologies (Analytics, Ads)
4.Purposes of processing and collection under Israeli law
4.1. We use the information for:
- Making contact and providing a requested service
- Supplying digital products / access to training
- Adapting marketing content and the user experience on the website
- Managing meetings, content consumption, digital products and support services
- Data analysis and improving the user experience
- Documentation for business management
- Complying with legal requirements, fraud prevention and information security
- Business decision-making and service optimization
- Managing campaigns and remarketing activity
- Sending offers, content and marketing messages – only subject to explicit consent under Section 30A.
4.2. Complying with legal requirements and managing legal, operational and information-security risks.
5.Disclosure to third parties
Information is disclosed only to the extent required and only to entities that meet legal requirements:
- Storage providers (Google, iCloud, Drives)
- Service providers linked to the business – video editor, website builder, automations and CRM system
- Authorized payment processors – Cardcom
- Mailing systems (Rav Messer)
- Automation systems (n8n / Zapier / Make / CobWeb CRM)
- CobWeb CRM system, Google Sheets lead-management system. The business uses a CRM system operated and maintained by an external provider, acting solely as a data processor and according to the business's instructions; the information is managed in a database in accordance with the law and regulations.
- Advertising platforms (Meta, TikTok, Google)
- Accountant and payment systems (subject to agreement)
- Social networks for advertising purposes
- Service providers that help operate the business
Every third party is obliged to meet privacy and security requirements under Section 13 of the Law and the Privacy Protection (Data Security) Regulations, 5777-2017.
We do not sell or transfer information for any purpose not required to operate the service.
6.Transfer of information outside Israel
Information may be stored on servers located outside Israel (for example Google Cloud, iCloud). Information is transferred only to countries with an adequate level of protection, or under appropriate contractual undertakings in accordance with the law, the data security regulations and the guidelines of the Privacy Protection Authority, including through accepted contractual mechanisms.
7.Information from social networks
If you communicate with the business through:
- TikTok
- Telegram
- YouTube
we may receive information that the platform allows under its permissions.
8.Purchase and payment information
During the purchase of a service/product:
- Payment-processing data (processed by an authorized provider only – we do not store or have access to credit card details)
- Invoice address – kept in accordance with tax laws only
- Purchase history
- Receipts and transaction records
The business is not exposed to the customer's credit card details.
The business is exposed to transaction and invoice details solely for management, service and compliance with legal requirements.
9.Data retention period
Information is kept only as long as it is needed:
- To provide the service
- To comply with legal requirements (invoices, tax, reports)
- To prevent future disputes
Information that is no longer needed will be deleted in accordance with the law and the Privacy Protection (Data Security) Regulations, 5777-2017.
Information is kept only according to legal requirements and business needs – as required.
10.Use of cookies and tracking technologies
10.1. The website uses cookies, identifying pixels and advertising identifiers for analysis and marketing.

10.3. Non-essential information will not be collected without consent.
11.Information security – full compliance with the regulations
In accordance with Sections 17A and 17B of the Law and the data security regulations framework, the business undertakes to implement all of the following requirements:
11.1 Organizational procedures
- An internal information security document for safeguarding the information – exists.
- Appointment of a privacy protection officer – Eyal Elmaliach (contact details appear below).
- Access permission controls
- Secure cloud storage
- Annual information security risk assessment
- Procedures for dealing with a security incident
- Working only with providers that meet international information security standards
- Nevertheless, we cannot guarantee absolute security.

11.2 Technological measures
- Encryption of information and communication (SSL)
- Use of strong passwords and two-step verification
- Secure backups in separate environments according to the type of information
- Logging of access to information
11.3 Information security incident
In case of suspected leakage:
- An internal investigation will be carried out
- Users will be updated as required by law
- The Privacy Protection Authority will be updated if needed
12.Promotional messages – Section 30A
12.1. Promotional messages and mailings will not be sent without an explicit checkbox / explicit prior consent from the user, in accordance with Section 30A of the Communications Law.
12.2. By leaving your details you approve receiving: messages / WhatsApp messages / email mailings. Every WhatsApp / email / SMS message will include an option to unsubscribe from the mailing list, and if none exists you can contact the business at eyalelmaliach2@gmail.com or via WhatsApp at +972-55-306-2277.
12.3. Any removal will be carried out immediately or within 3 business days at most.
12.4. Every registered user can remove themselves by contacting the business.
13.Characterization and distinction
13.1. “Customer” – a person receiving a paid service / support / product.
“Website user” – any person who is on the website and the pages subject to it and is entitled to consume the free content exposed to them there.
“Lead” – a person who left details on the website and its subordinate pages / another platform, for the purpose of making contact and receiving a service.
13.2. The website policy and terms apply to every website user and to every person who left details in the website registration form (registrations as a lead). If at some point you become a customer of the business (whether through a service you receive or a product you buy), you will probably be required, as a “customer”, to provide additional details not covered by this policy to the service provider (the business owner), such as: personal and sensitive information – as required and subject to law, in order to receive the services and products – raw materials and media, contact methods, user passwords, account and credit details for payment processing, address, answers and signatures on documents and questionnaires involving personal opinion and personal details, and the like... Therefore separate work agreements, policies and terms apply, tailored to each product and service the business offers, at the time of the transaction, with the approval, consent and full transparency of the service recipient / product purchaser, hereinafter the customer.
13.3. The manner in which customer information is retained is also governed by additional dedicated agreements.
14.User rights (Israeli law)
The user has the right to:
- Request a copy of the information
- Request correction of information
- Request deletion from the leads database and collected data (“the right to be forgotten”)
- Object to marketing use and be removed from mailing lists
- Withdraw consent at any time

15.Minors
The service and the website are not intended for persons under 18. If information is collected from a minor, a parent may request immediate deletion.
